REQUEST TO AMEND ARTICLE SIX SPECIFIC USE PERMITS AND CERTIFICATES OF OCCUPANCY AND RELATED SECTIONS OF THE ZONING ORDINANCE TO PROVIDE PROCEDURES FOR THE DENIAL AND REVOCATION OF CERTIFICATES OF OCCUPANCY BY THE CITY'S BUILDING.

OFFICIAL PETITIONERS, THE CITY OF PLANO. THIS ITEM IS FOR LEGISLATIVE CONSIDERATION.

GOOD EVENING. GOOD EVENING, JORDAN ROCKERBIE, LEAD PLANNER IN THE DEVELOPMENT SERVICES DEPARTMENT, TO PRESENT THIS ITEM. SO THIS ZONING CASE WAS DIRECTED BY THE CITY COUNCIL AND THE PLANNING AND ZONING COMMISSION.

CALL THIS PUBLIC HEARING ON MAY THE 5TH. CURRENTLY A CERTIFICATE OF OCCUPANCY.

APPLICATIONS ARE REVIEWED BY THE BUILDING INSPECTION DEPARTMENT.

THERE IS A SMALL PROCESS WHERE PLANNING REVIEWS AND ASSIGNS AN APPROPRIATE LAND USE TO APPEAR ON THAT CERTIFICATE OF OCCUPANCY.

THE ZONING ORDINANCE DEFINES CERTIFICATES OF OCCUPANCY, BUT DOES NOT HAVE PROCEDURES WITHIN THE ORDINANCE RELATED TO THEM.

MOST OF THE PROCEDURES FOR CERTIFICATE OF OCCUPANCY ARE FOUND IN THE BUILDING CODE.

HOWEVER, PER TEXAS LOCAL GOVERNMENT CODE CHAPTER 211 ANYTHING RELATED TO ZONING, SUCH AS A ZONING VIOLATION SHOULD GO THROUGH THE BOARD OF ADJUSTMENT. AS A ZONING ACTION. SO THE PROPOSED AMENDMENTS INCLUDE LANGUAGE ON WHAT CONSTITUTES GROUNDS FOR THE DENIAL OF A CERTIFICATE OF OCCUPANCY, AS WELL AS REVOCATION OF A CERTIFICATE OF OCCUPANCY.

THE AMENDMENTS ALSO CLARIFIES THAT THE CO CAN BE REVOKED WHEN IN VIOLATION OF THE ZONING ORDINANCE, AND SENDS THOSE VIOLATIONS THROUGH A PATH THAT INVOLVES THE BOARD OF ADJUSTMENT INSTEAD OF THE BUILDING STANDARDS COMMISSION.

SO THIS TOOL ALREADY EXISTS IN THE BUILDING CODE.

CURRENTLY, IF THE CITY WANTS TO REVOKE A CERTIFICATE OF OCCUPANCY, THERE IS A WRITTEN NOTICE OF THAT REVOCATION BY THE BUILDING OFFICIAL.

IF THE BUSINESS OWNER CHOOSES TO APPEAL THAT REVOCATION, IT GOES THROUGH THE BUILDING OFFICIAL AND THEN THROUGH THE BUILDING STANDARDS COMMISSION.

HOWEVER, AS MENTIONED, IF IT'S A ZONING VIOLATION, THE PROCESS SHOULD INSTEAD GO THROUGH THE BOARD OF ADJUSTMENT INSTEAD OF THE BUILDING STANDARDS COMMISSION. SO THESE AMENDMENTS WOULD INSERT THE BOARD OF ADJUSTMENT AND THE ASSOCIATED PROCESS WITH THE ZONING ORDINANCE APPEALS INTO THE ZONING ORDINANCE, AND THERE WOULD BE COMPARABLE AMENDMENTS IN THE BUILDING CODE WHEN ADOPTED.

SO THESE AMENDMENTS ARE IN CONFORMANCE WITH THE CITY'S COMPREHENSIVE PLAN LAND USE POLICY, AND WE RECEIVED NO CORRESPONDENCE RELATED TO THIS ZONING CASE.

SO RECOMMENDED FOR APPROVAL. AS PER THE AMENDMENTS NOTED IN THE STAFF REPORT.

ONE QUICK JUST CLARIFICATION. JUST FOR THE FOLKS WHO MAY BE WATCHING THIS, THIS IS A POWER THAT THE CITY STAFF ALREADY HAS TO REVOKE A CO FOR VIOLATIONS. WE'RE JUST CLARIFYING THE PROCESS AND INTRODUCING THE BOARD OF ADJUSTMENTS INTO IT.

IF IT'S A ZONING VIOLATION THAT CREATES THE NEED TO CONSIDER REVOKING THE KO.

IT WOULD ONLY BE VIOLATIONS OF THE ZONING ORDINANCE THAT WOULD GO TO BOARD OF ADJUSTMENT.

UNDERSTOOD. OKAY, AND THE ADDITION OF THE BUDGET, NOT THE ADDITION, NECESSARILY, BUT THE CLARIFICATION OF THE BOARD OF ADJUSTMENT PROCESS IS IN ORDER TO BE IN COMPLIANCE, ESSENTIALLY WITH THE TEXAS LGC SECTION 211.

THE REDEVELOPMENT AND GROWTH MANAGEMENT POLICY ACTION SEVEN PROVIDES GUIDANCE TO REVIEW THE COMPREHENSIVE PLAN EVERY TWO YEARS TO ENSURE CONSISTENCY WITH CITYWIDE GOALS AND RESPOND TO DEVELOPMENT TRENDS AND CHANGING CONDITIONS IN RESPONSE TO OUR GM SEVEN.

STAFF HAS ESTABLISHED THE COMPREHENSIVE PLAN MAINTENANCE REVIEW PROCESS AND DEVELOPED A TEN YEAR SCHEDULE TO ANNUALLY REVIEW VARIOUS COMPONENTS OF THE PLAN IN MANAGEABLE SECTIONS. THE BUILT ENVIRONMENT PILLAR IS CRITICAL TO LAND USE AND DEVELOPMENT DECISIONS, AND WILL BE REVIEWED EVERY TWO YEARS, CONSISTENT WITH THE GUIDANCE OF GM SEVEN TO MAKE THE REVIEWS MORE MANAGEABLE.

OTHER PLAN PILLARS ARE REVIEWED IN THE ALTERING YEARS, MAKING THE MAINTENANCE REVIEW AN ANNUAL PROCESS.

THE SCOPE OF THE MAINTENANCE REVIEW IS INTENDED TO BE MINOR IN NATURE, AND PROVIDE ROUTINE MAINTENANCE TO ENSURE THAT MAPS, PLAN POLICIES AND ACTIONS REMAIN, REMAIN CURRENT, AND PROVIDE RELEVANT GUIDANCE FOR IMPLEMENTATION PURPOSES.

THIS MAY INCLUDE UPDATES TO REFLECT CURRENT STATISTICS, FACTUAL CORRECTIONS, LATEST CONDITIONS OR TRENDS, AND STATUS OF POLICY ACTION. IMPLEMENTATION. THE REGIONALISM COMPONENT BACKGROUND WAS UPDATED WITH THE 2024 COMP PLAN AMENDMENTS, AND WE UPDATED THE POPULATION TO REFLECT CURRENT STATISTICS.

THE JOBS AND WORKFORCE DEVELOPMENT POLICY STATEMENT WAS UPDATED TO ALIGN WITH THE ECONOMIC DEVELOPMENT DEPARTMENT'S MORE INVOLVED ROLE IN THE JOBS AND WORKFORCE DEVELOPMENT ASPECT, AND THEN THE PLACEMAKING AND PUBLIC SPACES POLICY ACTION EIGHT WAS UPDATED TO REFLECT THAT THE DOWNTOWN PLANO ASSOCIATION WAS DISSOLVED.

HOWEVER THEY WERE STILL IMPLEMENTING THIS ACTION THROUGH WORKING WITH DOWNTOWN BUSINESSES AND STAKEHOLDERS, AND THEN THE 2023 COMPREHENSIVE PLAN AMENDMENTS INCLUDED THE UPDATE TO THE FUTURE LAND USE MAP, AND THIS WAS TO REFLECT THE PARKS MASTER PLAN MAP THAT WAS ALSO UPDATED IN 2023, SO IT IS SIMPLY AN ALIGNMENT OF THE TWO MAPS. THERE ARE SOME MAJOR UPDATES THAT WE DO NOT CONSIDER DURING THIS REVIEW PROCESS.

SO CONSISTENT WITH OUR GM SEVEN, MAJOR UPDATES REQUIRE BROADER INPUT AND ARE NOT CONSIDERED DURING THE MAINTENANCE REVIEW PROCESS.

MAJOR UPDATES ARE THOSE WHICH CHANGE UNDERLYING POLICY DIRECTION AND FUTURE LAND USE RECOMMENDATIONS, AND THESE TYPES OF UPDATES ARE EXPECTED AT THE TEN YEAR MARK WHEN WE PLAN TO REVIEW THE COMPREHENSIVE PLAN.

IN FULL. ADDITIONALLY, WE ARE MONITORING STATE LAWS THAT MAY BE ENACTED THAT COULD SIGNIFICANTLY IMPACT POLICIES OF THE COMPREHENSIVE PLAN IF AMENDMENTS ARE REQUIRED AS A RESULT OF STATE LEGISLATIVE ACTIONS.

THOSE WILL BE ADDRESSED AT A LATER TIME AND WOULD BE CONSIDERED AS A SEPARATE ITEM FOR COMMISSION REVIEW.

THIS YEAR WE ARE REVIEWING THE BUILT ENVIRONMENT PILLAR.

SO THAT INCLUDES THE LAND USE AND COMMUNITY DESIGN COMPONENT, TRANSPORTATION COMPONENT, HOUSING AND NEIGHBORHOODS COMPONENT, AND THEN WE ARE BRINGING FORWARD THE MAPS AS WELL.

SO YOU'LL BE SEEING THE FUTURE LAND USE MAP AND DASHBOARDS.

THIS EVENING, FOLLOWING THIS ITEM, YOU GUYS WILL BE SEEING THE RECOMMENDATIONS FOR THE TRANSPORTATION COMPONENT LATER THIS SUMMER.

WE'LL BE RETURNING WITH THE LAND USE AND COMMUNITY DESIGN RECOMMENDATIONS AND THE HOUSING AND NEIGHBORHOODS COMPONENT RECOMMENDATION.

THERE WILL BE MAPS THAT WILL BE GROUPED WITH THESE ITEMS. SO FOR EXAMPLE, THIS EVENING WITH THE TRANSPORTATION COMPONENT.

SO NUMBER ONE, AS WE LOOK AT THE BUILT ENVIRONMENT AND THE HOUSING AND NEIGHBORHOOD COMPONENTS, OUR GM SIX TALKS ABOUT CONDUCTING AN ANNUAL MARKET STUDY TO DETERMINE THE DEMAND BASED HOUSING AND EMPLOYMENT NEEDS FOR PLANO REFERENCED TO COLLIN COUNTY THAT MAY BE USED TO INFORM ZONING AND LAND USE RELATED DECISIONS, AND THE STUDY SHOULD INCLUDE THE RESIDENTS PREFERENCE FOR DEVELOPMENT AS PART OF THE RESULTS.

THE ROADWAY SYSTEM POLICY AIMS FOR THE DEVELOPMENT OF A SAFE AND EFFICIENT ROADWAY NETWORK THROUGHOUT THE CITY OF PLANO.

PROGRESS HAS BEEN MADE HAS BEEN MADE ON THIS POLICY THROUGH THE ADOPTION OF THE STREET DESIGN STANDARDS AND THE DOWNTOWN STREETS PLAN, AND THROUGH THE IMPLEMENTATION OF VARIOUS INTELLIGENT TRANSPORTATION SYSTEM IMPROVEMENTS.

UPDATES TO THE POLICY BACKGROUND TEXT ARE PROPOSED TO CLARIFY USERS OF THE ROADWAY NETWORK AND TO REFLECT CURRENT PROJECTS THAT ARE USED TO.

USED BY THE CITY TO MONITOR IMPROVE TRAFFIC CONDITIONS.

SPECIFICALLY FOR ACTIONS, RS4 IS UPDATED TO REFLECT THE STREET DESIGN STANDARDS THAT WERE ADOPTED IN 2023, AND RS5 WAS EDITED TO CLARIFY THAT PROJECT SPECIFIC CRITERIA, IS BASED ON BEST PRACTICES AND SHOULD BE USED TO EVALUATE THE PILOT TRANSPORTATION PROJECTS. SO THIS SUMMARY TABLE AND THIS MULTIPLE SUMMARY TABLES THAT WERE FOUND IN YOUR STAFF REPORT.

SO AFTER EACH POLICY AREA, THERE'S A SUMMARY TABLE THAT NOTES PROPOSED CHANGES AND WHETHER THERE'S NOT A CHANGE ON THE BACKGROUND POLICY.

HELLO, I AM EXCITED TO PRESENT TO YOU ALL AN UPDATE ON WHAT WE'VE BEEN DOING IN THE ENGINEERING DEPARTMENT IN REGARDS TO TRANSPORTATION AND HOW THAT RELATES BACK TO THE TRANSPORTATION COMPREHENSIVE PLAN.

ONE OF THE PILLARS OF THE TRANSPORTATION COMPREHENSIVE PLAN IS SAFETY, AND THAT IS REFLECTED IN OUR GOALS OF OUR DEPARTMENT.

SO OUR FOUR GOALS ARE SAFETY, TRAFFIC FLOW, IMPROVED WORK EFFICIENCIES AND THEN BEING GOOD STEWARDS OF THE CITY'S TAXPAYERS.

SO THIS SAFETY IS ALWAYS OUR NUMBER ONE PRIORITY, AND THEN WE LOOK AT THE NEXT STEP OF BEING TRAFFIC FLOW AND THEN EFFICIENCIES, AND SO WHEN WE'RE MAKING DECISIONS, WE ALWAYS THINK HOW DOES IT IMPROVE SAFETY.

HOW DOES IT IMPROVE TRAFFIC FLOW, AND IF SOMETHING CLASHES WE ALWAYS GO BACK TO SAFETY.

SO WITH THAT IN MIND WE DO AN ANNUAL CRASH ANALYSIS EVERY YEAR STUDYING EVERY CRASH THAT HAPPENS IN THE CITY, AND WE LOOK AT CRASH SEVERITY. WHAT CAUSED THE CRASH, WHAT TYPE OF INTERSECTION WAS IT? WHAT FACTORS WERE INVOLVED, WHETHER IT WAS A BICYCLE OR PEDESTRIAN OR JUST A VEHICLE CRASH? AND ALL OF THAT IS STUDIED AND, AND WE LOOK TO SEE WHAT MAJOR CHANGES CAN BE MADE TO EITHER THE NETWORK OR THE SYSTEM TO IMPROVE THE SAFETY OF WHY THOSE CRASHES ARE HAPPENING.

HOW CAN WE MITIGATE THOSE CRASHES? AND THAT INFORMS ALL OF OUR PLANS GOING FORWARD, AND SO ALL OF THESE IMPROVEMENTS THAT WE'VE MADE ARE INFORMED BY THIS CRASH STUDY EVERY YEAR. SO OUR CIP GROUP IS FUNDED TO DO INTERSECTION IMPROVEMENTS THROUGHOUT THE CITY.

SO THIS THIS MAP SHOWS WHAT'S BEEN DONE AND WHAT STILL NEEDS TO BE DONE.

OUR GOAL IS TO MAKE EVERY MAJOR, MAJOR INTERSECTION SO MAJOR ARTERIAL WITH A MAJOR ARTERIAL BEING TWO LEFTS, THREE THRUS AND A RIGHT. WHAT THIS DOES IS IT MAXIMIZES THE STORAGE FOR LEFT TURNING VEHICLES.

IT MINIMIZES WHAT WE CALL STARVING THE THROUGH LANE WHERE THE LEFT TURNS POCKET SPILLS OUT INTO THE THROUGH LANE, AND THAT MINIMIZES CRASHES, REAR END CRASHES AND DRASTICALLY IMPROVES THE SAFETY OF EVERY INTERSECTION.

WE'VE SEEN CRASHES GO DOWN WHERE WE HAVE THAT IMPLEMENTED, AND ONCE IT'S IMPLEMENTED, IT ALLOWS US A LOT MORE FLEXIBILITY WITH SIGNAL TIMING.

SO WE'VE ALREADY DONE 59 INTERSECTIONS LIKE THIS IN THE CITY.

WE HAVE 24 UNDER DESIGN AND WE HAVE NINE UNDER CONSTRUCTION RIGHT NOW.

SO THAT LEAVES ABOUT 68 STILL TO GO, AND WE'RE SLOWLY WORKING THROUGH THOSE WITH OUR CIP GROUP.

ON TOP OF THOSE INTERSECTION IMPROVEMENTS, WE'RE ALSO BUILDING NEW SIGNALS WHERE THEY'RE NEEDED. WHERE THERE ARE HEAVY CRASHES.

AT UNSIGNALIZED INTERSECTIONS, WE ALWAYS LOOK AT WOULD A SIGNAL IMPROVE THINGS, AND SO WITH THAT, WE BUILT NINE SIGNALS IN THE PAST YEAR OR, AND THREE OF THOSE ARE STILL IN CONSTRUCTION AND ARE ABOUT TO BE TURNED ON IN THE NEXT COUPLE OF WEEKS, BUT THE OTHERS ARE ALL BRAND NEW. THEY'RE RECENTLY TURNED ON, AND WE'VE GOTTEN GOOD RESULTS OUT OF THEM.

ONE OF THOSE MAJOR ONES IS UP THERE ON THE NORTH END OF TOWN AT TOWN SQUARE IN PRESTON.

THAT WAS THE HIGHEST CRASH LOCATION FOR UNSIGNALIZED INTERSECTIONS, AND SINCE THEN, IT HAS DRASTICALLY DROPPED.

SO WE WILL BE LOOKING AT THAT NEXT YEAR. ONCE IT'S BEEN ACTIVE FOR A WHOLE YEAR, WE CAN WE CAN REALLY SEE A BEFORE AND AFTER STUDY OF HOW THAT IMPROVES THINGS.

FURTHER IMPROVEMENTS OF EXISTING INTERSECTIONS.

WE HAVE A BIG $5.2 MILLION FEDERAL GRANT THAT WE ARE USING TO IMPROVE ALL OF THE DIAMOND INTERSECTIONS.

SO EVERYWHERE WHERE THERE'S A FRONTAGE ROAD TYPE SITUATION, WE HAVE 31 IN THE CITY WITH TWO INTERIOR, AND THEN THE REST ARE ALL ON OUR HIGHWAYS. WITH THIS, WHEN THE CITY WAS BUILT OUT, ALL OF THESE DIAMONDS WERE BUILT TO DIFFERENT FEDERAL OR STATE STANDARDS. OVER THE YEARS, AND SO THERE'S NO CLEAR DESIGN THAT IS APPLIED TO EACH ONE, AND SO EACH ONE IS A LITTLE DIFFERENT. SO WE'RE GOING TO COME THROUGH AND WE'RE GOING TO STANDARDIZE ALL THE PAVEMENT MARKINGS, SIGNS AND SIGNALS.

WE'RE GOING TO IMPLEMENT WRONG-WAY DRIVING MEASURES, AND WE'RE GOING TO ADD A LOT OF PEDESTRIAN AND BICYCLE SAFETY IMPROVEMENTS AND PEDESTRIAN ELEMENTS. SO THAT WILL BE COMING TO CONSTRUCTION SOMETIME NEXT YEAR.

ONE OF THE OTHER PILLARS OF THE TRANSPORTATION COMP PLAN IS INTELLIGENT TRANSPORTATION SYSTEMS. SO THE REST OF THESE IMPROVEMENTS THAT I'M GOING TO TALK ABOUT ARE ALL THESE ITS PROJECTS.

WE CALL THEM OUR TECHNOLOGY PROJECTS. THE PLANO IS CURRENTLY GOING THROUGH THE LARGEST TRAFFIC SYSTEM OVERHAUL THAT WE KNOW OF, AT LEAST IN THE STATE, POSSIBLY IN THE COUNTRY.

WE'RE OVERHAULING EVERY SINGLE PIECE OF TRAFFIC TECHNOLOGY IN THE CITY. WE HAVE CURRENTLY FINISHED ALL OUR SCHOOL ZONE FLASHER SYSTEM ALLOWING PREVIOUSLY PUBLIC WORKS HAD TO GO OUT TWICE A YEAR AND MANUALLY UPDATE EVERY SINGLE FLASHER WITH WITH THE NEW SCHOOL ZONES.

NOW WE CAN REMOTELY DO THAT. WE HAVE UPGRADED TO A NEW VEHICLE EMERGENCY VEHICLE PREEMPTION SYSTEM.

THAT HAS ALLOWED US TO LOCK DOWN THAT SYSTEM AND PREVENT LANDSCAPERS WHO BOUGHT EMERGENCY VEHICLE PREEMPTION UNIT OFF OF AMAZON TO GET FREE ACCESS ACROSS THE CITY, AND THAT HAS DRASTICALLY IMPROVED TRAFFIC FLOW BECAUSE EVERY TIME A VEHICLE IS TRIGGERED THAT MESSES WITH SIGNAL TIMING. WE HAVE WE HAVE FULLY OPERATIONAL TRAFFIC MANAGEMENT CENTER UP IN THE ENGINEERING SUITE, WHICH YOU ALL ARE ALL WELCOME TO COME VISIT ANYTIME YOU WOULD LIKE. WE LOVE SHOWING THAT OFF, AND WE ARE CURRENTLY ROLLING OUT NEW CABINETS AND CONTROLLERS.

SO THIS MAP THAT YOU SEE BEFORE US IS ALL OF THE NEW CONTROLLERS THAT WE'VE ROLLED OUT. WE'RE CURRENTLY AT 70% ROLLOUT WITH ANTICIPATION TO HAVE THOSE DONE FULLY COMPLETE IN THE NEXT COUPLE OF MONTHS. THE NEW CABINETS AND CONTROLLERS GIVE US A LOT MORE FLEXIBILITY WITH EQUIPMENT AND SIGNAL TIMING.

IT GOES FROM 16 INPUTS MAX TO NOW, 32 INPUT MAX.

LIKE I SAID, FLEXIBILITY IS REALLY IMPORTANT BECAUSE IT JUST LETS US DO MORE WITH SIGNAL TIMING.

THE NEW CABINETS YOU CAN SEE HERE GIVES US A LOT MORE FLEXIBILITY TECHNOLOGY WISE FOR ANYTHING THAT GROWS IN THE FUTURE.

SO THIS IS WE'RE TAKING FROM EARLY 2000 TECHNOLOGY TO A MODERN TECHNOLOGY WITH SPACE TO GROW.

IF ANYTHING COMES WITH DRIVERLESS VEHICLES WHERE WE NEED TO BE ABLE TO COMMUNICATE WITH THEM, WE'LL BE ABLE TO PUT THAT INTO THESE NEW, NEW CABINETS.

THE. MOVING ON. THE LAST THING THAT WE'RE DOING IS VISIBILITY ACROSS THE CITY.

SO NO, MY QUESTION WASN'T NECESSARILY IN WRITING TICKETS, BUT IT WAS MORE OF THE GOVERNMENTAL SUPER STATE OF ALWAYS HAVING EYES ON EVERYWHERE WE'RE GOING.
