AND WHEREAS ON JANUARY 1ST, 1863, PRESIDENT ABRAHAM LINCOLN ISSUED THE FINAL EMANCIPATION PROCLAMATION, WHICH DECLARED AMONG OTHER THINGS THAT ALL PERSONS HELD AS SLAVES WITHIN THE REBEL STATES ARE, AND HENCE FORWARD SHALL BE FREE.

JUNETEENTH, ALSO KNOWN AS FREEDOM DAY, JUBILEE DAY, LIBERATION DAY, AND EMANCIPATION DAY IS A HOLIDAY THAT CELEBRATES THE EMANCIPATION OF THOSE WHO HAVE BEEN ENSLAVED IN OUR NATION.

OUR DIVISION'S MISSION IS TO EDUCATE AND ENGAGE THE COMMUNITY IN SUSTAINABLE PRACTICES AND ENVIRONMENTAL STEWARDSHIP.

HOW DO WE TOUCH THE PUBLIC? UH, REALLY WE THROUGH A LOT OF DIFFERENT WAYS.

WE OFFER PROGRAMMING IN TERMS OF CLASSES AND WEB WEBINARS AND EVENTS, WEBSITE RESOURCES, ONLINE TRAINING MODULES.

WHAT I LOVE IS THAT WE'RE NOT AFRAID TO CHANGE.

WE'RE CONSTANTLY TRYING TO KEEP OUR PROGRAM FRESH AND WEEDING OUT THE PROGRAMS THAT ARE NO LONGER EFFECTIVE.

I'M MOST PROUD OF THE WAY THAT THIS PROGRAM HAS DEVELOPED.

THE STAFF IS CONSTANTLY LOOKING FOR THE NEXT THING.

THEY HAVE JUST GREAT VISION.

THEY LOVE WHAT THEY DO, THEY LOVE THE CITY.

UM, THEY REALLY DO WANT TO MAKE THE CITY BETTER FOR TOMORROW.

BUT LUCKY FOR US, WE HAVE A COMMUNITY THAT ALREADY CARES.

IT'S JUST ABOUT GETTING THE INFORMATION OUT TO THEM SO THAT THEY CAN GET INVOLVED IN THE THINGS THAT THEY ALREADY CARE ABOUT.

OUR VOLUNTEER PROGRAM IS VERY ROBUST.

WE HAD A LITTLE OVER 5,000 VOLUNTEERS LAST YEAR, AND OF THOSE VOLUNTEERS, THEY DONATED ALMOST 15,000 HOURS AND THEY'RE ABLE TO ACCOMPLISH SO MUCH.

IT'S REALLY AMAZING.

WE HAVE CURRENTLY AROUND 42 ACTIVE REGULAR PLANO COMMUNITY GARDEN VOLUNTEERS.

THE CITY LIAISONS WERE GREAT.

THEY WERE ALL INTO PROVIDING EVERYTHING YOU NEEDED HERE AT THE GARDEN.

IF YOU HAD ZERO EXPERIENCE OR YOU WERE A VETERAN GARDENER, IT WAS A GREAT PLACE TO BE.

AND TOGETHER LAST YEAR, THEY WERE ABLE TO GROW AND DONATE ALMOST 5,000 POUNDS OF PRODUCE.

MUCH OF WHAT WE DO HAS TO DO WITH EDUCATION AND OUTREACH, AND THE ENVIRONMENTAL EDUCATION CENTER WAS BUILT AND PUT THERE, NOT JUST AS AN EXAMPLE OF A SUSTAINABLE BUILDING AND THEN THE BEAUTIFUL GARDENS AROUND IT.

IT WAS ALSO MEANT TO BE A PLACE WHERE PEOPLE CAN GATHER AND LEARN.

I TEACH PROGRAMS TO ADULTS AND KIDS, AND I ALSO WORK ON DIFFERENT PROJECTS, REALLY TO HELP TEACH PEOPLE ABOUT HOW TO RECYCLE AND THEN ALSO HOW TO REDUCE YOUR WASTE.

YOU KNOW, WE'VE DONE CLASSES IN THE PAST, BUT WE'VE NEVER HAD SOMETHING THAT WAS AVAILABLE TO ANYONE, UM, IF THEY HAVE FIVE MINUTES TO SPARE.

AND WE DECIDED TO, UM, CREATE OUR FIRST LEARNING MODULE CALLED TAKING CARE OF THE TRASH, WHICH REALLY HELPED EDUCATE RESIDENTS ABOUT RECYCLING AND WASTE MANAGEMENT.

IF WE CAN GIVE THE RESIDENTS OF PLANAR THE INFORMATION THEY NEED TO MAKE THE DECISIONS THAT ARE RIGHT FOR THEM IN TERMS OF SUSTAINABLE BEHAVIORS, THAT'S A WIN.

MY NAME IS LISA MARIE WILLIAMS. I AM ONE OF THE 64% IN SURVEY , WHO FEEL UNCOMFORTABLE WITH AN S T R IN THEIR NEIGHBORHOOD.

I'VE BEEN A NEIGHBORHOOD VOLUNTEER AND A CIVIC CIVICALLY ACTIVE PLANO RESIDENT AND HOMEOWNER FOR OVER 29 YEARS.

I'M OPPOSED TO SHORT-TERM RENTALS OPERATING IN SINGLE FAMILY RESIDENTIAL NEIGHBORHOODS.

ALTHOUGH I AM PLEASED WITH THE COUNCIL'S RECENT ACTION IN PLACING A TEMPORARY BAN ON THESE STRS, I FEAR THIS ACTION ALONE IS NOT ENOUGH.

I, ALONG WITH THE MAJORITY OF MY PLANO NEIGHBORHOOD RESIDENTS WHO ARE HERE TONIGHT BY PROXY TO THEIR VOICE, THEIR OPINION WITH ME, THEY WANT TO KNOW WHAT THE CITY'S ACCOUNTABILITY TO ALL OF US WILL BE IN KEY KEEPING THESE SHORT-TERM RENTAL PROPERTIES LAWFUL IN MY NEIGHBORHOOD.

THE STRS ARE OWNED BY SOMEONE WHO LIVES OUT OF STATE AND SUPPOSEDLY ARE MANAGED BY A SOMEWHAT LOCAL COMPANY.

WHEN NON-COMPLIANT ISSUES ARISE AT THESE LOCATIONS, NEIGHBORS CALL LAW ENFORCEMENT AND OUR POA BOARD USUALLY MAKES NUMEROUS CALLS TO THE MANAGEMENT COMPANY, WHO THEN OF COURSE SAYS THAT THEY'LL CALL THE OWNER.

RESULTS ARE SKETCHY, THEY'RE USUALLY DELAYED, AND THEN, OF COURSE, TAKEN CARE OF BY THE NEIGHBORS THEMSELVES.

WILL THE CITY BE POLICING THESE PROPERTIES IN THIS WAY? REMNANTS OF OVERCO OVER OCCUPIED PARTIES, LITTER OUR STREETS AND ALLEYS WITH CARS OVERLY LOUD MUSIC, BROKEN LIQUOR BOTTLES AND CANS, OVERFLOWING TRASH CANS, INTOXICATED PARTIERS, AND EVEN UNCLOTHED PERSONS WEEKEND AFTER WEEKEND.

IT'S LIKE DEJAVU, 20 SECONDS ALL OVER AGAIN.

IT SEEMS THAT YOU CITY COUNCIL MAY CONTINUE TO EXPECT YOUR CITIZENS TO POLICE THESE PROPERTIES.

WE DO WANT TO KEEP OUR NEIGHBORHOOD SAFE, AND THAT'S THE PLAIN AND SIMPLE FACT.

WE ARE PRETTY SURE THAT REQUIRING A REGISTRATION OF THE SHORT TERM RENTALS AND RECEIVING HOTEL TAX MONIES WILL NOT CHANGE THE SITUATIONS THAT EXIST LIKE THESE.

I PRESENT MY CASE, UH, TO POINT TO THE, UH, IMPORTANCE OF ESTABLISHING A STRONG AND EFFECTIVE ENFORCEMENT MECHANISM OF THE SHORT-TERM RENTALS, REGISTRATION, AND A REGULATION.

IN ORDER TO LET PEOPLE COMPLY WITH A SHORT-TERM RENTALS LEGAL REQUIREMENT, THERE MUST BE CLEAR AND SERIOUS CONSEQUENCES ASSOCIATED WITH ILL ANY VIOLATION.

A HOUSING IN OUR NEIGHBORHOOD IS REGISTERED WITH MULTIPLE BUSINESSES.

THIS VIOLATES TEXAS HOME OCCUPATION CODE, UH, WHICH EXPLICITLY STATES THAT NO MORE THAN ONE HOME OCCUPATION IS PERMITTED WITH ANY SINGLE DWELLING UNIT, UH, ET CETERA.

THEY LEASE OUT THEIR HOME FOR GROUP COUNSELING, UH, SERVICE WITH NO BUSINESS PERMIT.

THEY ALSO RUN THE BEAUTY SALON AND THEIR HOME

HIRING MORE THAN ONE EMPLOYEES.

AS SUCH, STRANGERS HAVE BEEN PARKING RIGHT IN FRONT, IN FRONT OF A HOME HOMES WHEN THEY SHOULD HAVE LIMITED THEIR PARKING ONLY TO THE FRONT OF THE HOUSE OF A HOME OCCUPATION, THE CARS AND TRUCKS OF THE EMPLOYEES, AND THE CUSTOMERS CLOCK OUR STREET, MAKING IT UNSAFE FOR SCHOOL BUSES AND DELIVERING TRUCKS TO NAVIGATE THROUGH OUR NEIGHBORHOOD STREET.

ALL THOSE VIOLATIONS ARE ALL, THOSE ARE THE VIOLATIONS OF PLANOS ZONING ORDINANCE, UH, HOME OCCUPATION.

OUR NEIGHBORHOOD HAS BECOME INCREASINGLY UNSAFE, WHERE OUR HOME PROPERTY VALUES DEPRECIATED 20 SECONDS, UH, DUE TO UNSAFE AND UNSIGHTLY SURROUNDINGS.

C'S ENFORCEMENT MECHANISM AT HOME OCCUPATION HAS BEEN NOT INFECTED.

FIRST, A RESIDENT ALLOWS TO CALL ONE TIME PER DAY, UH, TO THE, UH, DEPARTMENT, BUT KEEP IN MIND CUSTOMERS COMING AND OUT THROUGHOUT THE DAY.

IT WAS JUST A FEW MONTHS AGO THAT 30 GUNSHOTS WERE FIRED IN FRONT OF MY HOUSE AT AN OUT OF CONTROL SHORT-TERM RENTAL PARTY.

IT HAPPENED WITHIN 90 DAYS OF THE HOUSE BEING LISTED ON AIRBNB AND V R B O.

OBVIOUSLY, WE'RE ALL STILL VERY TRAUMATIZED.

I CAN'T EVEN SPEAK .

UM, WHEN I HEARD THAT THERE WAS ANOTHER TERRIFYING SHORT-TERM MENTAL SHOOTING IN DALLAS LAST WEEK, I KNEW I WOULD HAVE TO COME UP HERE.

OUR SAFETY AND OUR LIVES ARE AT RISK, AND WE CAN'T FORGET THAT A YOUNG MAN WAS KILLED AT A PLANO SHORT-TERM RENTAL PARTY IN SHOOTING IN 2019.

AND IT'S HARD FOR ME TO UNDERSTAND WHY THE SHORT-TERM RENTAL ISSUE IS STILL BEING DEBATED THREE AND A HALF YEARS LATER.

THE THESE ARE NOT ISOLATED INCIDENTS.

THERE ARE STUDIES THAT SHOW SHORT-TERM RENTALS LEAD TO AN INCREASE IN VIOLENT CRIME.

THERE HAVE BEEN AT LEAST 338 SDR SHOOTINGS IN THE LAST FOUR YEARS, AND THOSE ARE JUST THE SHOOTINGS.

THE LIST OF VIOLENT AND NONVIOLENT CRIMES LINKED TO STRS IS EXTENSIVE.

I DIDN'T BUY A NEXT TO A HOTEL NIGHTCLUB ENTERTAINMENT VENUE OR A PUBLIC SWIMMING POOL THAT CAN BE RENTED BY THE HOUR, BUT THAT'S WHAT'S BEING ALLOWED TO HAPPEN IN OUR NEIGHBORHOODS.

PARTY BANS DON'T WORK, AND OUR POLICE DEPARTMENT SHOULDN'T BE BURDENED WITH POLICING SHORT-TERM RENTALS.

20 SECONDS.

THE ONLY SOLUTION IS A FULL BAN.

THE CITY OF FAIRVIEW GOT IT RIGHT.

THEIR NEW ORDINANCE AND BAN STATES THE BAN IS NECESSARY FOR THE HEALTH, SAFETY, AND WELFARE OF THE GENERAL PUBLIC.

IT'S TIME FOR PLANO TO STEP UP AND MAKE RESIDENT SAFETY A PRIORITY AND BAN SHORT-TERM RENTALS.

IT IS A FACT THAT MY HOUSE RECEIVED A BULLET IN MY FRONT WINDOW AND MULTIPLE WALLS.

IT IS A FACT THAT ON JUNE 5TH IN MIDWAY HOLLOW, ON THE BLOCK OF VALLEY RIDGE, PEOPLE HIT THE FLOOR WITH THEIR PETS AND THEIR LOVED ONES.

UM, THEY ARE APPROVED AS ZONING OVERLAY DISTRICTS.

THAT'S WHY THIS IS A ZONING CASE.

UM, THERE ARE SOME CRITERIA BEING, FIRST OF ALL, THE PROPERTY MUST BE 50 YEARS OLD, AND SECONDLY, IT MUST MEET TWO OF THE CRITERIA OUTLINED IN THE HERITAGE PRESERVATION ORDINANCE.

I BELIEVE THERE ARE EIGHT CRITERIA THERE.

SO WE CURRENTLY HAVE 34 DESIGNATIONS FOR INDIVIDUAL LANDMARKS.

AND THEN THE LAST DESIGNATION WAS FIVE YEARS AGO WHEN THE SAING HOUSE WAS DESIGNATED.

SO WHAT ABOUT THE TEXAS POOL? WHY IS IT COMING BEFORE YOU THIS EVENING? WELL, IT WAS BUILT IN 1961, SO, UM, THAT IS 62 YEARS YOUNG FOR SOME OF US THINKING THAT THAT IS NOT TERRIBLY OLD, BUT IT STILL DOES MEET THE HERITAGE REQUIREMENTS.

UM, IT IS ALREADY LISTED ON THE NATIONAL REGISTER OF HISTORIC PLACES, UH, THAT HAPPENED INTO IN 2019, AND IT'S CURRENTLY OPERATED BY THE TEXAS POOL FOUNDATION AND HAS BEEN RESTORED OVER THE LAST SEVERAL YEARS WITH HELP FROM THE HERITAGE PRESERVATION GRANT PROGRAM.

SO THIS IS COMING BEFORE YOU THIS EVENING BECAUSE, UM, SOME OF THE FUNDING FOR THIS YEAR'S GRANT WAS ACTUALLY CONDITIONED ON PURSUING THIS DESIGNATION.

THEY DO HAVE A NATIONAL DESIGNATION, BUT DIDN'T YET HAVE A LOCAL DESIGNATION.

SO THE HERITAGE COMMISSION FELT STRONGLY THAT IT WOULD BE HELPFUL TO, UH, PROTECT THE INVESTMENT OF THE CITY BY GOING AHEAD AND GETTING A LOCAL DESIGNATION.

SO THEY DID APPLY IN 2022.

UM, WE HAD SOME COMPLICATIONS WITH THE SURVEY, WHICH, UM, HAVE DELAYED US SLIGHTLY, BUT WE'VE GOT THOSE RESOLVED AND SO ARE HERE BEFORE YOU THIS EVENING.

SO THE HERITAGE RESOURCE DESIGNATION CRITERIA ARE, UM, THE KIND OF MEASURING STICK BY WHICH WE UTILIZE THE HERITAGE PRESERVATION ORDINANCE TO LOOK AT NEW DESIGNATIONS.

AND SO WE FOUND THAT HALF, WELL, THE MINIMUM REQUIREMENT IS TWO OR 25% OF THE CRITERIA.

UM, WE FOUND THAT FOUR OF THE CRITERIA ARE 50% APPLY TO THIS PROPERTY.

IT DOES POSSESS A SIGNIFICANCE IN HISTORY, ARCHITECTURE, ARCHEOLOGY, OR CULTURE.

IT IS A, IT IS A, A, WE BELIEVE THE FIRST, UH, EARLIEST KNOWN EXAMPLE OF A TEXAS SHAPED SWIMMING POOL.

SO THAT'S A FUN FACT FOR YOU.

I KNOW THERE'S BEEN A LOT OF INFORMATION ALREADY PRESENTED TO YOU, SO I'M JUST GONNA GO THROUGH THIS RATHER QUICKLY.

UH, TEXAS POOL, OBVIOUSLY WAS OPENED IN 1961, UH, PART OF THE DALLAS NORTH ESTATES, UH, PUT TOGETHER BY HERBERT HUNT THAT WAS SOLD IN 1962 FOR THE WHOPPING SUM OF $1 TO THE DALLAS NORTH COMMUNITY CLUB FOR THE NEXT THREE DECADES.

UH, THE POOL OPERATED, WE DON'T HAVE A WHOLE LOT OF INFORMATION ON, ON THE HISTORY OF THAT TIME PERIOD, BUT, UH, IT WAS SUCCESSFUL PEAKED IN THE MID NINETIES.

MEMBERS WOULD CAMP OUT OVERNIGHT TO GET ONE OF THE COVETED SPOTS.

ALL THE ORIGINAL STRUCTURES WERE MAINTAINED AND REMAIN INTACT.

UH, MURAL WAS ADDED TO THE EXISTING PUMP HOUSE IN 2007.

THE POOL IS COMPLETELY OPERATED BY VOLUNTEERS, SO IT'S, THERE'S A LOT OF WORK THAT GOES INTO IT.

, UH, TEXAS POOL FOUNDATION MISSION IS TO PRESERVE THE TEXAS POOL AS A LANDMARK, SUPPORT THE COMMUNITY THROUGH OUTREACH AND EVENTS, AND TO PROVIDE ACCESS TO SWIM, SAFETY, EDUCATION, SWIM LESSONS, AND SWIMMING OPPORTUNITIES FOR THE PUBLIC.

THROUGHOUT THE, UH, 2000 TENS AND INTO THE TWENTIES, UH, THE POOL HAS UNDERGONE SOME RENOVATIONS WITH GENEROUS ASSISTANCE THROUGH THE HERITAGE GRANT FOUNDATION.

UH, IT'S ALSO ENSURED THAT ANY HISTORIC ASPECTS OF THE POOL HAVE BEEN MAINTAINED, AND WE'VE BEEN ABLE TO KEEP SOME HISTORIC INTEGRITY.

OBVIOUSLY, IT'S, UH, SIGNIFICANT.

UH, AS TOUCHED ON EARLIER, IT'S THE EARLIEST KNOWN POOL SHAPED AS TEXAS.

ALL THE ORIGINAL STRUCTURES ARE STILL PRESENT AND OPERATIONAL.

IT'S A STRANGE TERM I FEEL LIKE TO USE, BUT WHAT THAT ENSURES US IS IF FOR WHATEVER REASON, ANY OF THE VENDORS FROM THE CONTRACTOR, HE HAS TO GO OUT, HE HAS TO GET BIDS FOR EACH OF THE COMPONENTS OF THE CONTRACT AND THEN PUT THAT GUARANTEED MAXIMUM PRICE TO US.

WE SAW THAT IT WAS IN OUR BUDGET.

WE FELT LIKE IT MET OUR NEEDS, WE ACCEPTED IT.

UH, THE LAND IS OWNED BY THE PLANO HOUSING AUTHORITY WITH A LEASE BACK TO THE OPERATING COMPANY.

UM, THE OPERATING COMPANY IS PARTLY OWNED BY PLANO HOUSING AUTHORITY, UH, M V H PARTNERS, WHICH IS NOW REBRANDED AS PIVOTAL HOUSING PARTNERS.
